These Terms & Conditions (“Terms”) govern your access to and use of the Zooboo website, products and services. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our website or services.

1. Eligibility

By using our website, you confirm that:

• You are at least 18 years of age or are using the website under the supervision of a parent or legal guardian.
• You have the legal capacity to enter into a binding agreement.
• All information provided by you is accurate, complete and up to date.

2. About Zooboo

Zooboo offers personalised products designed and manufactured based on customer-provided photographs, names, artwork, messages and other customization inputs.

As each product is created specifically for the customer, many of our products are manufactured only after an order has been successfully placed.

3. Customer Accounts

You may browse our website without creating an account. However, certain features may require you to register.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• Restricting access to your account.
• All activities carried out under your account.

Please notify us immediately if you suspect any unauthorized use of your account.

4. Orders & Acceptance

Placing an order on Zooboo constitutes an offer to purchase our products.

All orders are subject to acceptance by Zooboo.

We reserve the right to:

• Accept or reject any order.
• Cancel orders suspected to be fraudulent.
• Cancel orders where required information is missing.
• Refuse orders containing prohibited or unlawful content.
• Limit quantities purchased by a single customer where necessary.

If an order is cancelled after payment has been received, an appropriate refund will be processed in accordance with our Refund Policy.

5. Personalization & Customer Responsibility

Many Zooboo products require customer-provided personalization.

It is your responsibility to ensure that:

• Names, spellings and messages are accurate.
• Uploaded photographs are of suitable quality.
• You carefully review your personalization before placing the order.
• The information provided is complete and correct.

Once production has commenced, personalization details generally cannot be modified.

Zooboo is not responsible for errors resulting from incorrect information submitted by the customer.

6. Ownership of Uploaded Content

By uploading photographs, artwork, logos or other personalization content, you confirm that:

• You own the content or have obtained all necessary permissions to use it.
• The content does not infringe any copyright, trademark, privacy or other legal rights.
• You have permission from any identifiable individuals appearing in the content where such permission is legally required.

You retain ownership of your uploaded content.

By submitting such content, you grant Zooboo a limited, non-exclusive, royalty-free licence solely for the purpose of:

• Producing your personalised products.
• Processing your order.
• Quality assurance.
• Customer support.
• Replacements or reprints where applicable.

This licence automatically ends once the applicable retention period described in our Privacy Policy has expired.

7. Prohibited Content

Customers must not upload content that:

• Is unlawful.
• Is defamatory.
• Contains hate speech.
• Is sexually explicit.
• Promotes violence.
• Infringes intellectual property rights.
• Contains malware or harmful software.
• Violates the privacy rights of others.

Zooboo reserves the right to reject or cancel any order containing prohibited content.

8. Product Representation

We make every reasonable effort to accurately display product colours, designs and materials.

However, actual products may vary slightly due to:

• Screen settings.
• Device displays.
• Printing processes.
• Material characteristics.
• Manufacturing tolerances.

Minor variations in print placement, colour and alignment are considered normal for personalised products.

9. Pricing

All prices displayed are inclusive or exclusive of applicable taxes as indicated on the website.

Prices may change without prior notice.

Pricing errors may occasionally occur.

Where a pricing error is identified before dispatch, Zooboo reserves the right to cancel the affected order and issue an appropriate refund.

10. Payments

Payments may be made using the payment methods available on our website.

Payment processing is handled through trusted third-party payment partners.

Zooboo does not store your complete payment card information.

11. Shipping & Delivery

Estimated delivery timelines are provided for convenience only.

Actual delivery may vary due to:

12. Cancellations

Orders may be cancelled before production has commenced.

Once production has started, cancellation may not be possible because the products are manufactured specifically for the customer.

Any approved cancellations shall be processed in accordance with our Cancellation & Refund Policy.

13. Returns & Replacements

Due to the personalised nature of our products, returns based solely on:

• Change of mind,
• Incorrect customer-provided personalization,
• Customer ordering mistakes,

may not be accepted.

However, Zooboo will review requests involving:

• Manufacturing defects.
• Printing defects.
• Incorrect products received.
• Products damaged during transit.

14. Intellectual Property

All website content, including but not limited to:

• Graphics

are owned by or licensed to White Ventures Online Pvt. Ltd. unless otherwise stated.

15. Limitation of Liability

To the fullest extent permitted by law, Zooboo shall not be liable for:

• Indirect or consequential damages.
• Loss of profits.
• Business interruption.
• Customer errors in personalization.
• Delays caused by third-party logistics providers.
• Events beyond our reasonable control.

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer protection laws.

16. Force Majeure

Zooboo shall not be liable for delays or failure to perform obligations arising from events beyond our reasonable control, including but not limited to:

• Natural disasters
• Government actions
• Strikes
• Internet failures
• Power outages
• Pandemic-related restrictions
• Transportation disruptions

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, the courts having jurisdiction over the registered office of White Ventures Online Pvt. Ltd. shall have exclusive jurisdiction over disputes arising under these Terms.
